Exclusive Fatwa : Judgement is for HIM and from HIS Shari’ah exclusively !

Question: All praise belongs to Allah the lord of all creation and may the salah and salam be upon the Messenger of Allah and those who gave their allegiance to him, to proceed…

To the noble scholars, may Allah grant you all success, as-salamu ‘alaykum wa rahmatullahi wa barakatuhu, as for what follows:
A memo has been issued to the judges by the number 13/Ta/2071 on the date 5/9/1423 H, attached herein adopting to not take complaints to Shari’ah courts concerning what gets published in the papers and magazines and delivering it to the media department instead. Also, what gets published in the papers like in the economic journal, number 3331 on the date 18/Ramadan/1423 H, directed by the justice minister to the court’s judges with the necessity of complying with the verdict, article 37 from the scheme of print outs and publications, and it dictates that: “The affairs related to publications in the papers is exclusive to the media department, not the Shari’ah courts. A committee looks into the specific differences within the system itself, is comprised of decisions from the media minister, and is headed by the deputy of the ministry who has authorization. Its members aren’t less than three, each one of them would be a legal consultant and the committee issues decisions based upon the majority vote after inviting the opposition or whoever represents him and listening to his statement. It is permissible to invite whoever it sees can be heard regarding his opinions, just as it’s permissible for it to seek aid by whom it sees fit, and the decisions made by the committee aren’t approved except after the ministry conforms to it.” So, what is your opinion regarding this? And may Allah preserve you all.

The Exposition Regrading the Disbelief of the one that Assists the Americans.

When the events of September 11th took place in America, from day one, those in authority there immediately accused (some of the Muslimīn) of being behind the actions. Before the investigations were completed, they began to prepare for their general crusader campaign in order to finish off Islām under the name: “The War Against Terrorism,” and despite their clear and obvious targeting of Islām in this campaign, there are some from the naïve ones or hypocrites who may delude and deceive with their words. Therefore, I shall mention in the following section clear-cut and irrefutable proofs that prove that this campaign is directed against Islām.

The evidences that I shall mention are divided into two categories:
Category One: General Evidences
Category Two: Specific Evidences

As for the First Category: the general evidences, they are from the Sharī’ah and the current affairs.

As for what is from the Sharī’ah
Allāh the Glorified clearly declared the enmity of the disbelievers towards the Muslimīn and that they will not cease fighting them until they are able to cause them to turn away from their Dīn and that they will not be pleased except with the Muslimīn entering into their way and that their enmity will never cease:
The Most High said, “And al-fitnah is worse than killing. And they will never cease fighting you until they turn you back from your way  if they can.”
The Most High said, “Never will the Jews nor the Christians be pleased with you [O Muhammad (sallallāhu ‘alayhi wa sallam)] till you follow their way.”
The Most High said, “They wish that you disbelieve, as they have disbelieved, and thus that you all become equal.”
The Most High said, “Should they gain the upper hand over you, they would behave to you as enemies, and stretch forth their hands and their tongues against you with evil, and they desire that you should disbelieve.”
The Most High said, “Many of the People of the Book wish that if they could turn you away as disbelievers after you have believed, out of envy from their own selves, even, after the truth has become manifest unto them.”
The Most High said, “O you who believe! If you obey a group of those who were given the Scripture (Jews and Christians), they would (indeed) render you disbelievers after you have believed!”
The Most High said, “O you who believe! If you obey those who disbelieve, they will send you back on your heels, and you will turn back (from Faith) as losers.”
The Most High said, “Hatred has already appeared from their mouths, but what their breasts conceal is far worse.”

Barriers of Takfeer

Question: What are the barriers of Takfeer? 

Answer: Before knowing the Mawani’ (barriers) we should know the reasons for Kuffr; they are belief, saying, action, and/or doubt. This is because the definition of Kuffr is every saying, or action, or, belief that the texts make Takfeer for it and removes its doer from the Millah. 

Its elaboration is as follows: 
Barrier to the label of shirk; it is ikrah. He said, “Whoever disbelieves in Allah after his belief, except for one who is forced while his heart is secure in faith.” 
Barriers of Takfeer in issues that are obscure; which are those matters which are known only to specific people and what is intended by it (obscure issues) are the issues related to the people of desires and bida’ such as matters of Asma and Sifat, Imaan, Qadr, and other issues similar to that and other than the the extremists from them. 

The Mawani’ here are:
  1. Ignorance.
  2. Tawil.
  3. Blind following.
  4. Ikrah.
  5. Lack of texts to know the truth.
  6. Or it reached him but it was not confirmed with him.
  7. Or it was confirmed but he was not able to understand it.
  8. Or it was confirmed with him but a contrary argument was shown which led him to a tawil.
  9. Or a misconception overcame in which Allah will excuse him.
  10. Or he was a mujtahid in search of the truth.

Diseases of the Murji’ah in Takfeer...

Question:
As-Salaam Aleykom Shaykh, May Allah grant you good and a long life. A while ago when you spoke about takfeer, the mistakes that happens (when you apply it), and the outcome of it. And this scenario maybe happening, but because of this a new way (Manhaj) has appeared, that which we call irjaa of today. They have made the religion more softer than the clothes of Samir as mention by some of the Salaf. Can you give us more details about this or explain to us (Murjism) in general? Would you like to mention anything about that for us?

Answer:
Correct! When the Manhaj (Methodology) of Khawarij appeared, as an outcome of that, the Manhaj of Murji’a appeared, and Ahlu Sunnah is between the Khawarij and Murji’a.

The Khawarij make takfeer because of major sins, and Murji’a don’t make takfeer on the Nawaqid (Nullifiers of Islam), and they restrict the nawaqid to (a persons) Juhood (denying) and making the Halaal Haraam and similar.

And Ahlu Sunnah is between these. So the one who commits a deed of Kuffr and all the conditions are full field, and all the barriers are removed, and this is not required for all the nullifiers, because there are some that aren’t in need of this (i.e to fulfill the conditions and remove the barriers). So the ruling on such a person is clear, he committed an act that nullifies the principle of Imaan.

And what is Kuffr? This is a speech, deed, belief that nullifies the principle of Imaan, and can’t exist together with Imaan.


Al-Murji’ah and Al-Kuffr !

And the people of the Sunnah have agreed that the Kuffr can be due to a statement, such as clear mockery (Istihza’) of the religion (Deen) and it can occur due to actions such as prostrating to an idol or the sun or the moon or slaughtering for other than Allah. 

And the evidences from the Book and the Sunnah are clear concerning the Kuffr of someone who commits something of Kuffr, and this is due to the statements or actions alone, without tying this to willful rejection (Juhud) or making it permissible (Istih’laal) as this is erroneous and no one from the companions (Sahabah) or the generation that came after them (Tabi’een) nor the known Imaams of the Sunnah have said this. 

Allah said: “And if you ask them (about this), they will declare: “We were only talking idly and joking.” Say: “Was it at Allah, and His Ayat (Proofs, Evidences, Verses, Lessons, Signs, Revelations, etc.) and His Messenger that you were mocking?” Make no excuse; you have disbelieved after you had believed. If We pardon some of you, We will punish others (amongst you) because they were Mujrimin (disbelievers, polytheists, sinners, criminals, etc).” [9:65] 

And the cause of Kuffr was the statement, which they uttered alone. 

And Allah said: “They swear by Allah that they did not say (anything bad), but really they said the word of disbelief, and they disbelieved after their Islam, and they resolved that (plot to murder Prophet Muhammad) which they were unable to carry out, and they could not find any cause to do so except that Allah and His Messenger had enriched them of His Bounty. If then they repent, it will be better for them, but if they turn away, Allah will punish them with a painful torment in this worldly life and in the Hereafter. And there is none for them on earth as a Wali (supporter, protector) or a helper.” [9:74]
 

A glimpse on the history of Makkah...

History informs us about what happened during specific points in the past as well as events that have taken place over time and gives us information related to this. Such information may be true or false, and every Muslim is obliged to seek the truth and confirm any information he hears so that he may ascertain what is correct from what is fabricated. Moreover, every Muslim should refer to reliable sources in order to obtain definite, authentic and verifiable information.

Makkah is the Sacred City as well as the holiest and the absolutely most honorable place on earth. The most truthful sources from which one can take news about its history are the Qur’aan and the authentic prophetic narrations in this regard, and from these we can ascertain its ancient history as well as how it was prior the message and prophethood of Muhammad (saws).

After the advent of Islam, Muslim scholars and historians have endeavored to record chronicles of Makkah in general history books as well as books concerned with the biographies of the Muslim scholars who lived in it. Some scholars authored books that dealt primarily with its history and the areas surrounding it, one of the most famous being “Chronicles of Makkah and its Ancient Monuments” authored by Abu Al-Waleed Al-Azraqi from the third century AH. Another book was “Chronicles of Makkah in Ancient and Contemporary Times” authored by Al-Faakihi who also lived during the third century AH, and his book was larger than that written by Al-Azraqi but the initial parts of his book were lost over time.

Thereafter, chronicling the affairs and events of Makkah ceased for a period of almost four centuries. It was thereafter resumed and one of the scholars who is considered to be the most prolific author regarding it and its history was Imaam Taqiyyud-Deen Al-Faasi Al-Makki (775 AH - 832 AH). In his book entitled “The Therapy for those who Harbour Affection for the History of the Sacred City”, Imaam Taqiyyud-Deen expressed his amazement at the fact that chronicling the history of Makkah had halted after Imaams Al-Azraqi and Al-Faakihi.

Being Defeated an evidence for Deviation?

Question: Is defeat considered evidence of having a deviation in Manhaj?

Answer: Materialistic or military defeat, in a battle or in battles, is not evidence of having a deviation in Manhaj or having a mistake in the path, as some people might misunderstand. The Awliya and the prophets might be tested, Allah said, “And these days (of varying conditions) We alternate among the people.” [3:140] Imaam ibn Kathir said regarding this Ayah, “We allow the enemy to overcome you sometimes, though the final outcome is for you, due to what We have of wisdom regarding that.”

In “Sahih Muslim,” from ‘Abdillah ibn ‘Amr that he said, “Prophet (saws) said, ‘There is no raiding party that raids, retrieves ghanimah, and returns safely except that they have hastened a third of their rewards. And there is no raiding party that raids, loses ground, and is wounded except that they receive all of their rewards.’”

And Imaam Ahmad, and others, have narrated from ‘Abdillah ibn Salamah that he said, “I have seen ‘Ammar (ibn Yasir) on the Day of Siffin; an old man, brown and tall, and the spear in his hands is trembling while saying: ‘By He whom my soul is in His Hand, I have fought with it with the Messenger of Allah (saws) three times and this is the fourth, and if they fight us, until they push us back to the leaves of Hajar, I would have known that we are on haqq and they are on baatil.’”


Islamic History

The great Indian Islamic scholar and historian Abu Al-Hasan ‘Ali An-Nadwi observes, like other sages of Islam have before, that Islam, being the last and universal religion of Allah, has a unique history of internal revival, reform and self-rejuvenation.

Allah sent the message of Islam at a chosen moment in the development of human history where the technological, scientific and intellectual understanding of humanity as a whole was reaching a stage of final maturation and ripening. Instead of geographically confined nations and tribal systems which all received their own messengers from Allah, the humanity was now ripe for one, universal, perfected and final message of Allah.

The development of the Islamic Ummah in history was amazingly rapid. It was full of trials and tribulations and encounters with other cultures and religious systems. As a result, the final message of Allah was embodied in a civilization that was enriched by all the great civilizations of the world. Within the first century of its birth, Islam spread across half the known and majority of the civilized world of that time. As different people became Muslims or came under the rule of Islam, the scholars and thinkers of Islam came from increasingly diverse regions, thus enriching the flowering and protection of Islamic scholarship and tradition with their own cultural strengths. The contributions of the Persians in bureaucracy and culture, the Hindus in mathematics, the Greeks in logic, the Turks in military and architecture fields, just to name a few, all became sources of strength of Islam. On the other hand, the previous philosophical and religious systems of the new lands both challenged and influenced the Muslim scholars and thinkers. All these factors make the history of Islam extremely fast-moving, diverse and filled with conflicts, debates and upheavals. Each of these experiences, however, also helped it mature and develop.

Whenever the Ummah of Islam faced a new danger, internal or external, Allah raised among the Muslims scholars, leaders and groups who protected the true religion of Allah and revived it in its true, pristine form. This ubiquitous phenomenon is known to the historian as revivalism or tajdeed.


What is Russia up to in the Middle East ?!?

“What is Russia up to in the Middle East?”

Such was the title of a short book written some months ago by an expert in Russian affairs. To know and keep up with the realities of the world and why your enemies move the way they do is essential in today’s time just as it was in the past. Possibly in the days of the Prophet (saws) it was not as easy to know and it took much more effort to gain access to what your enemy was thinking and planning but today they write books on such, and all praise belongs to Allah. 

History

The author starts with mentioning that imperial Russia is fully aware of its heritage and history, that being it sees itself as a continuation of Rome (a “third Rome” said by the author). Driven by the desire of greed imperial Russia is no new comer to the Middle East and the eastern part of the Mediterranean (where the pagan religion of Christianity was received by them). With the decline of the pagan state of the Ottomans the pagan empires of Europe and Russia then began to fight over what was left and for claiming the authoritative right of the protector of the pagan Christians. 

The “Great Game” as the author calls it then plays out between Russia and Britain for the goods of this worldly life. Points noted through reading the history and the history of all pagan empires is what drives them is their lustfully pursuit of the worlds treasure and for spreading corruption. In complete contrast to this is the noble driving force in which the believing slaves of Allah wage war for (from the kingdom of Sulayman to the state founded by the Prophet). Allah said, “Those who believe fight for the cause of Allah, and those who disbelieve fight for the cause of the taghut.” Such manifests itself in the history of the believers and the ignorant pagan disbelievers.

Shaykh Muhammad al-Amin ash-Shanqiti in Adwa al-Bayan, 2/319 on the Tafsir of the Ayah in al-A’raf: “Indeed your Lord is Allah, Who created the heavens and the earth in Six Days, and then He istawa (rose over) the Throne...” [7:54]
 

Know that, in regard to the issue in question, countless people from recent centuries have erred, claiming that what first comes to mind from Ayaat that describe such attributes as “rising over the Throne” and with regards to the hand of Allah is comparison between Allah and created beings.

Based on that assumption, they say that we all must turn away from that apparent meaning. However, anyone with the least bit of sense will understand that their claim involves a dangerous assumption. That being, whenever Allah describes Himself in His Book, the meaning that first comes to mind from that description, involves Kuffr in Allah and statements that are not appropriate for Him, the possessor of Might and Majesty. Yet, contrary to the implications of their claim, Allah said in the Prophet (saws), “And We have revealed to you the reminder, that you may make it clear for the people as to what is down to them.” [16:44]

Based on their claim, the Prophet (saws) did not explain the meanings of Ayaat which deal with the attributes of Allah. However, there is a consensus among the scholars of Islam that is was neither possible, nor permissible for the Prophet (saws) to have delayed explaining an issue that the people needed to understand. More than anything else, people needed to understand that Islamic ‘Aqeedah, especially when, as per their claim, the apparent meaning that first comes to mind from certain Ayaat involves Kuffr and misguidance; such that, we need to have explained the “true” meaning of such Ayaat by the ignorant people of recent centuries. They claim that Allah spoke words wherein the apparent meaning that first comes to mind involves Kuffr, and so we must turn away from that meaning.


A dialogue with Shaytaan....

Deep at night, I had this dialogue with Shaytaan. Shortly, I heard the Fajr (dawn) prayer call and I wanted to go to the Masjid...

     He (Shaytaan) said: “The night is still long, so take a nap.”
     I said: “I’m afraid I’ll miss my obligatory prayer!”
     He said: “There is much time to go.”
     I said: “I’m afraid I’ll miss praying in congregation.”
     He said: “Don’t be too harsh on yourself in worship.”

Then, I didn’t wake up until the sun had already risen.

    He whispered to me again saying: “Don’t feel sorry for what you have missed. The day is still full of many other chances.”

As soon as I started mentioning Allah, he brought to my mind all kinds of thoughts.

    I said: “You are diverting me from making Du’aa.”
    He said: “Just delay it until the night.”
Shortly, I intended to repent.
    He said: “Enjoy your young age before it comes to an end”!
    I said: “I’m too afraid of death.”
    He said: “But your life will not end now.”

I started to memorize Quraan.

    He said: “Entertain yourself with songs.”
    I said: “But it’s an unlawful thing to do.”
    He said: “Scholars differed on that matter
.”   
    I said: “The evidences from the Prophet’s (saws) sayings are with me.”
    He said: “But you know their sources are weak!”

A beautiful lady passed by, so I lowered my gaze.


Line between Major and Minor Shirk !

Every instance of Shirk in Tawheed al-Ilahiyyah and al-‘Ibaadah negates Tawheed. And this Shirk is of two types: The clear major Shirk, and the subtle minor Shirk.

Major Shirk

It is to make a rival to Allah that is called upon as Allah is called upon, or to fear him, or hope in him, or love him, as Allah is loved, or to render a type of worship to him. This is the Shirk which does not leave its doer with any Tawheed at all, this is the Mushrik that Allah has forbidden from Jannah, and his abode is the Fire.

It does not matter whether the worship rendered to other than Allah is called worship or Tawassul, or even if it is given a name other than these. All of that is major Shirk, because what is important is the reality of the thing and its implication, not the word or expression used to describe it.

Minor Shirk

This is every saying or action which leads to Shirk, like aggrandizing creatures in a way that does not quite reach the level of worship. Like, for example, making an oath by other than Allah, or showing off, etc.
