SHIA - !!!

Obviously, the laws and facts overlaying the mut’ah marriage (nikah) practised by the Shi'ahs are no different from hiring a car. Those facts are as follow: 

Nikah Mut’ah  is not a marriage that restricts to only four wives. 

Women who are 'wedded' mut’ah are hired women, so it is allowed to practice nikah mut’ah even with 1,000 women simultaneously, because the akad (contract) of mut’ah is not a marriage. If indeed it is a marriage, then it is limited to 4 wives only.

Such are the women for the “ma'sum” imam of the Shi'ahs, they are leased goods that could be renmted and returned without any liability whatsoever. There is no different from the cars which are returned after being rented. 

The Main Preconditions For Nikah Mut’ah 

In nikah mut’ah, the most important are the time period and mahar (dowry). If both have been mentioned in the akad, then the akad mut’ah of them both is binding. Because, like what will be explained later, the relationship of the mut’ah “marriage” ends with the completion of the agreed time period. If the time period is not agreed upon, then it has no difference from the marriage that is commonly known in Islam. 

The same as rented goods, for example cars. If we are renting a car, there must be two agreements with the owner of the car, how much is the lease and how long we want to rent. 

Minimum Limit of the Mahar of the Mut’ah

It was mentioned above that the rules of akad mut’ah is the presence of an agreement on the time period and mahar. How much is the minimum limit of the mahar of the nikah mut’ah? 

Once again, it all depends on the agreement between the two parties. It is very compatible for those with limited wallet, that they can give mahar by treating lunch at the McDonald, KFC or nasi uduk (Indonesian style steamed rice). 

There is no Talaq (divorce) in Mut’ah 

In nikah mut’ah the term “talaq” is unknown, because as explained above, nikah mut’ah is not a marriage that is commonly known in Islam. If the relationship of the marriage, that is commonly practised in Islam, ends with several things and one of them is talaq, then the relationship of the nikah mut’ah ends with the elapsing of the time period that had been mutually agreed upon. As is known in the narration above, the agreement on the time period of the mut’ah is one of the important principles/elements in mut’ah besides the agreement on the mahar. 

Minimun Time Period of Mut’ah 

In nikah mut’ah, there is no minimum limit as regards the mut’ah time period. So,  it is possible that the nikah mut’ah is within a time period of one day, one week, one month, or even for a one-time sexual intercourse.

The people who do nikah mut’ah are allowed to do anything a husband / wife normally do in a marriage that is commonly known in Islam, until the agreed time period is complete. If the agreed time period has been completed, both of them are no longer a husband and wife, alias no more mahram who are haram to be viewed, touched and so on. What if there happens a mut’ah agreement on a one-time sexual intercourse? Whereas, after consociating just like a husband and wife, they are no longer a husband and wife, where the ruling on the consociation of non-mahram man and woman applies? Surely, time is needed to get organized and clothed, before both of them go their own way. 

Nikah Mut’ah Rrepeatedly Withour Limits 

It is lawful to do nikah mut’ah with a woman repeatedly without limits, unlike the normal marriage, where, when a woman has been given 3 talaq, then she has to get married with another man first before being allowed to remarry the first husband. This is as explained by Abu Ja’far, the fourth Shi'ah Imam, because a mut’ah woman is not a wife, but a leased woman. Just like rented goods, one is allowed to rent something and return it, and then rent again and return it again repeatedly with no limit. 

The Mut’ah Women are given Mahar according to the number of Days agreed upon 

Women who are 'wedded' mut’ah receive her portion of the mahar in accordance with the number of days agreed upon. If it turns out that the women are leaving then the mahar can retained.

Payment must be in accordance with the agreed number of days, so that no loss will befall the renter.

If it turns out that Woman who is given M ut’ah already has a Husband or is a Prostitute, then the Mut’ah is Uninterrupted by Itself 

If a man wants to propose nikah mut'ah to a woman and asks about her status, then he must believe the confession of that woman. If it turns out that the woman is lying, by saying that she is a virgin but in fact she already has a husband, that is the responsibility of that woman just now.

No need to waste time by asking, straight away propose and pay. 

Nikah Mut’ah with the Virgins 

From Ziyad bin Abil Halal said : I heard Abu Abdullah it is okay to do mut’ah on a girl as long as you don't have intercourse with her from the qubul (anal), so as not to bring dishonor to her family. Al Kafi volume 5 pg. 462.

Yeah, this is not a marriage. 

Nikah Mut’ah with the Prostitutes 

Nikah Mut’ah is allowed even with prostitutes. Whereas, we have learned above that women who are 'wedded' mut’ah are rented women. If you can rent a good woman, surely it is even more possible to hire a woman whose profession indeed is subletting herself.

Ayatollah Udhma Ali Al Sistani said :
It is better not to, but if forced, it is still called nikah even with a prostitute. The prostitute will be happy because, aside from getting money and pleasure in her work, she also gets the heavenly reward. 

The Relation of an Inheritance 

Ayatollah Udhma Ali Al Sistani in his book wrote : Case #255 : Nikah Mut’ah does not cause inheritance relations between the husband and wife. And if they both agree, the act of the agreement was still questioned. But do not ignore the principle of caution in this case. (Minhajusalihin.  Volime 3 Pg. 80) 

Nafkah (maintenance - clothing, food, lodgement, etc.) 

Women who are 'wedded' mut’ah is not entitled to receive nafkah from her husband.

Case #256 : A man who marries mut'ah with a woman, is not obligated to give nafkah to the mut’ah wife even if the wife is pregnant from his seed. The husband is not obliged to stay in the place of his wife unless it has been agreed in the mut’ah contract or other binding contract. Minhajus salihin. Volume 3 pg. 80.
